They can't control something they don't own any sort of rights for. Sure they own the game. But none of the mods these guys make. I promise you they aren't going to waste the time and money to go after these guys. They will just lose money in the process.

I guarantee you every suppose lawsuit you are speaking of they barely received any money from vs what they put in towards lawyers and such lmao. End of day they say whatever they want but people will always continue to do exactly what they want anyway. Have you actually read the terms and conditions or just going off what you saw someone say?? No where does it ever state they gain ownership for the mod you created. They would be opening themselves up to a lawsuit claiming they own stuff they don’t have any licensing to. They simply state selling mods for gain is prohibited. End of day that’s all they can and will ever do. I’ve yet to find anything online ever stating that they filed lawsuit and likely never had. To many loopholes that lawyers would find on it and not to mention the money they would be wasting in the process. Remember just because you can bring someone to court and win doesn’t mean you’ll see what the court told them to pay you.
